ASSAULTS, AGGRAVATED ASSAULTS AND DOMESTIC VIOLENCE
- 8/17/22 Retaliation: DISMISSED Client was accused of threatening to kill a police officer who arrested him for DWI. The State to timely indict client. Paul Doyle asked the court to dismiss the case because of this error and the case was dismissed.
- 6/16/22 Assault: DISMISSED Client was at a party with her high school friends. Client was intoxicated and got into a verbal argument with another girl that was attending the party. Client attempted to leave the party when complainant slammed client’s hand in her car door. Client responded by punching complainant. Paul Doyle explained that this was mutual combat and the case should be dismissed. The State ultimately agreed and dismissed the case.
- 4/29/22 Assault Family Member Felony Choking: DISMISSED Client is accused of beating and choking his girlfriend. Client’s girlfriend called the police and client fled the scene. Police found complainant with bruises on her face as well as bleeding. Complainant told police at the scene that client choked and beat her after she accused him of cheating on her. Complainant ultimately recanted her story and said she attacked client and he was just defending himself. Case was set for trial and the State dismissed the case on the eve of trial.
- 4/12/22 Aggravated Assault (Road Rage): DISMISSED Client is a doctor. Client was driving home from work when complainant swerved at client almost running him off the road. Client exchanged words with complainant who began to reach for something in his car. Client pulled out his pistol to warn complainant. Complainant then chased client and called police. Police officer illegally identified Client by showing complainant his driver license photo thus tainting the identification. Law enforcement must show a photo spread in that situation. State had no other way to identify client so the case was dismissed.
- 3/21/22 Assault Family Member Felony Choking: DISMISSED Complainant was the girlfriend of client. Complainant was extremely intoxicated and emotional. Complainant hit her head on a cabinet and told the police client assaulted her. Paul Doyle’s investigator spoke to complainant who admitted that she could not recall what happened. Paul Doyle presented this evidence to the State and the state agreed to dismiss the case.
- 3/21/22 Violation of Protective Order; DISMISSED Client was on bond for Assault Family Member. A protective order was issued. Client was not to have contact with his girlfriend. Client went to dinner with his girlfriend and was followed home from the restaurant and was robbed because of the Rolex he was wearing. Client called the police due to the robbery and the detective noticed client was in violation of the protective order and arrested client. The State dismissed the case because it was the right thing to do.
- 3/21/22 Assault Family Member: DISMISSED Client was returning from a casino in Lake Charles with his girlfriend. The girlfriend was extremely intoxicated and attempted to jump out of client’s car. A police officer happened to drive by when this occurred. Client was stopped and complainant had injuries to her face and claimed client hit her. Paul Doyle explained to the State that client was trying to keep his girlfriend from jumping out of his car and hurting herself and that is what caused the injuries. The case was ultimately dismissed.
- 2/11/22 Aggravated Assault (Road Rage): DISMISSED Client was driving home from dinner with friends when complainant began to tailgate client. Client slowed down and complainant drove up next to client and began to scream profanity at client. Client pulled his pistol out and pointed it at complainant in self-defense. Complainant called the police and followed client to his house. Paul Doyle explained to the State that client was acting in self-defense and client cannot have a felony on his record because he works in hospitals. The State initially did not agree that this was a case of self-defense so Paul Doyle threatened to set the case for trial. The State ultimately agreed and dismissed the case.

- 6/22/22 DWI: DISMISSED Client is a veteran police officer with 18 years on the force. Client was asleep at an intersection. Citizen call police for a welfare check. Patrol arrived on scene and called for backup because client was a police officer. Law enforcement has a limited amount of time to detain a citizen without conducting an investigation. We informed the State that this was an illegal detention and that we were going to file a Motion to Suppress the stop. We provided the State with the relevant case law and the case was dismissed. Client was able to return to work.

- 8/24/22 Sexual Assault: DISMISSED Client runs a construction company. Client met complainant on a dating site. Client met up with complainant on multiple occasions to have sex. On the last occasion, complainant claims client forced her to have anal sex and beat her. Client initially hired less expensive counsel and case was set for trial. Paul Doyle was hired for trial and immediately began preparing his defense. Paul Doyle presented the facts corroborating a consensual relationship and the State agreed. The State dismissed the case shortly before trial.

- 8/24/22 Burglary of a Habitation: DISMISSED Client went to complainant’s house to collect a debt. Complainant claims client broke into his house and threatened him with a gun. Case was set for trial and Paul Doyle was hired to replace client’s current counsel. Paul Doyle’s investigative team found complainant’s landlord who witnessed client knocking on complainant’s door and complainant allowing client to enter his house. Paul Doyle provided the State with this new evidence and the case was dismissed shortly before trial.
- 2/18/22 Theft >2500 <30,000: DISMISSED Client was accused of stealing property from a neighbors backyard. Client was found with the property in his car. Paul Doyle established that the State could not prove the value of the property that was stolen. The State agreed and dismissed the case.
